Bus Driver Arrested in 70th Precinct

MTA employee was charged with assault at 7:47 a.m. on Tuesday.

At 7:47 a.m. on Tuesday, Dec. 18, an MTA employee was arrested and charged with assault within the confines of the 70th Precinct, according to police.

Q 35 Bus Driver Robert Volkens, 42, was on duty when a man attempted to board his bus without paying a fare, police said.

Another passenger paid the man's fare, the man boarded, rode the bus and when he went to exit, he spit at Volkens, police said. Volkens reacted and was then arrested and charged with assault in the third degree, police continued.

Police could not confirm the exact location of the incident. The incident is under investigation.

So it's not assault to spit on someone? That's germs and viruses being flung at someone. Why was that guy not arrested too?

Thanks for writing, Maggie. That's a great question. I plan on following up with the police department to learn the outcome of this situation and will be sure to keep readers informed of any updates going forward.
